Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and W. D. Data Solutions, LLC (“Prospekt,” “we,” “us,” or “our”), governing your use of the Prospekt mobile app and the prospektsports.com website (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

• You must provide accurate account information and keep it up to date. You are responsible for activity that happens under your account and for keeping your login credentials secure.
• Age is confirmed before anything else. When you create an account, we ask for your date of birth before we ask for or collect an email address, a password, or any other information.
• Under 13. The Service is not directed to children under 13, and a person under 13 may not independently use or operate the Service or create their own account. If our age check identifies a signup attempt as under 13, that signup is stopped immediately and no account, email address, or other information from the attempt is retained. A player under 13 may only be represented on Prospekt through a profile that a parent or legal guardian creates and manages from their own account, as described in Section 2 below.
• Ages 13–17. A person 13 to 17 years old may create their own account only if a parent or guardian is aware of and consents to their use of the Service. Before completing signup, we show a summary of what information is collected, how it is used, and that sharing is off by default and controlled by the account holder.
• Managed profiles. If you create or manage a profile for another person (such as your child or a player on your team), you represent that you are authorized to do so and to provide their information, and that you will supervise their use of the Service.

2. Children’s Privacy & Parental Controls

Prospekt is a general-audience service and is not directed to children under 13. This section describes how the Service is nonetheless designed to work for players under 13 — entirely through a profile a parent or guardian creates and controls, never through a child’s own account. It supplements, and does not replace, the fuller description of our data practices in our Privacy Policy.

• No direct signup for children under 13. As described in Section 1, a person identified as under 13 cannot create an account or submit any personal information through the signup flow. The only way a player under 13 is represented on Prospekt is as a managed profile that a parent or guardian creates and controls from within their own account.
• The parent or guardian is in control. The account holder who creates a managed profile decides what information is entered for it. Only a first and last name are required — date of birth, state, email address, and playing details are optional and can be left blank without preventing the profile from being created or used.
• Reviewing, changing, or deleting a child’s information. The account holder may review, edit, or permanently remove a managed player’s profile and the data associated with it at any time from within the app, or by contacting us at support@prospektsports.com.
• No ads, no selling data. We do not use a managed player’s information to serve targeted advertising, and we do not sell it to third parties.
• Sharing is approval-gated. Nobody other than the account holder can view a player’s real stats, games, or video without the account holder’s explicit approval. Anyone requesting access must submit their name and email address; approval is granted individually by the account holder, and the private link to view the data is delivered only by email to the address that was approved. Access can be revoked by the account holder at any time.
• Video is opt-in, not passive. Video recording is a feature the account holder actively turns on for a specific game; it is never collected automatically or without that choice.
• Questions or requests. A parent or guardian with questions about a child’s information, or who wants to exercise any right described above, may contact us at support@prospektsports.com.

3. License to Use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial player-development purposes. You may not copy, resell, reverse-engineer, or attempt to extract the source code of the Service, except to the extent this restriction is prohibited by law.

4. Your Content & Data

You retain ownership of the game data, statistics, notes, and video you record (“Your Content”). You grant us the limited rights needed to host, process, and display Your Content in order to operate and provide the Service to you — for example, storing your data, calculating your statistics, and generating development reports at your request. Our handling of your personal information is described in our Privacy Policy.

5. Acceptable Use

You agree not to:

• Use the Service in violation of any law or the rights of others;
• Upload content you do not have the right to use, or that infringes another person’s intellectual-property or privacy rights;
• Record or upload another person’s data or likeness without the authority or consent to do so;
• Attempt to disrupt, overload, or gain unauthorized access to the Service or its systems.

6. Imported Data

The Service may let you import statistics from a spreadsheet or export file you provide, or from a photo of a printed or handwritten stat sheet, grade sheet, or box score. You are responsible for having the right to use any data you import, and for its accuracy. Imported data is labeled as lower-confidence than data tracked directly in the app, and is kept separate from your verified, in-app records. A photo you upload for this purpose is used only to transcribe its contents and is not retained afterward.

7. Third-Party Services

The Service relies on third-party providers, including Supabase (hosting, authentication, and storage), Anthropic (AI-generated reports and photo transcription), Firebase (crash and diagnostic reporting), and Resend (transactional email). When in-app purchases are available, Apple processes payment through the App Store. Your use of the Service may also be subject to the terms of the platform through which you obtained the app.

8. Development Reports Are Informational

Prospekt’s AI-generated development reports are provided for informational purposes only. They are generated from the data you record and do not constitute professional coaching, medical, or recruiting advice. You are responsible for how you use them.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data or statistics will be accurate or complete.

10. Limitation of Liability

To the fullest extent permitted by law, W. D. Data Solutions, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or twenty U.S. dollars ($20).

11. Indemnification

You agree to indemnify and hold harmless W. D. Data Solutions, LLC from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of the rights of another person, including any content or data you record or import.

12. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate access to the Service if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination (such as Sections 9–11) will survive.

13. Changes to the Service and These Terms

We may modify the Service or these Terms from time to time. When we make material changes to these Terms, we will update the “Effective date” above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States and the State of Tennessee, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Tennessee will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to venue in those courts.
